Position and Functions
1. Department of Natural Resources and Environment is the professional agency of the provincial People's Committees of central standing provinces and cities. Its functions are advising and assisting the provincial People's Committees (PPC) in managing the resources and environment sectors, including land, water resources, mineral resources, geology, environment, meteorology, geodesy and cartography; implementation of public services in the areas under the management of the Department.
2. Department of Natural Resources and Environment has legal status, separate stamp and account as prescribed by law; is under the direction and management about organizing, staffing and operating of the PPC; and under the direction, guidance, inspection, examination of the Ministry of Natural Resources and Environment on professional activities
Responsibilities and Rights
1. Submitting the provincial People's Committee:
a) Drafts of decisions, directives and other documents issued under the authority of the PPC in the field of natural resources and the environment;
b) Drafts of five-year and annual plans; programs, schemes and projects in the field of natural resources and environmental and solutions of managing, protecting natural resources and the environment in the area;
c) Drafts of document specifying the conditions and criteria for granting the title of chairman and vice-level of organizations under the Department and the leaders and deputies of Natural Resources and Environment of provincial districts, towns and cities.
2. Submitting the President of the PPC:
a) Drafts of documents issued under the authority of the president of the PPC in the field of natural resources and the environment;
b) Drafts of decisions on establishment, merger, dissolution, reorganization professional offices, agency and carrering units under the Department of Natural Resources and Environment’s the management; drafts of decisions defining the functions, tasks, powers and organizational structure of the branches of the Department as prescribed by law;
c) Drafts of documents specifying in the working relationship among the Department of Natural Resources and Environment, the relevant departments, and People's Committees of provincial districts, towns and cities (called DPC).
3. Guiding, organizing, implementing and inspecting legal documents, plans, programs, schemes, projects, standards, technical regulations and economic and technical norms in the field of natural resources and environment issued by the authority; informing, disseminating, educating about law of natural resources and environment in the province.
4. On land:
a) Mornitoring and coordinating with relevant agencies to establish and adjust the plan of using local land to submit the PPC; guiding and supervising the implementation of land using plan approved;
b) Evaluating the land using planning by the DPC submitting the PPC for approval; checking the implementation of district land using plan approved;
c) Evaluating the documents on land allocation, land lease, land eviction, land using right transfer, land using purpose transfer, certificates of land using and ownership and using of property attached to the land;
d) Issuing certificates of land using and ownership and using of property attached to the land as authorized by the PPC; land lease contract, the registration of land using and ownership and using of property attached to the land as prescribed by law;
e) Guiding and supervising the implementation of procedures for land allocation, land lease, land eviction, land using right transfer, land using purpose transfer, certificates of land using rights and ownership and using of property attached to the land; the land using right registration, establishment and management of cadastral documents; the implementation of the rights and responsibilities of land users;
f) Guiding, inspecting and conducting the investigation, survey, measurement, evaluation, classification of land; establishing and adjusting of changes in cadastral map, maps of land using status and maps of land using planning; carrying out statistics of land and building information systems of provincial land;
g) Mornitoring to estimate land valuation, submiting to Department of Finance before the PPC prescribes annual valuation of local land to be suitable to land price frame issued by the Government; proposing solution of the problems about land prices; organizing the investigation, collecting and providing information and data of land prices;
h) Mornitoring and coordinating with relevant agencies to guide, test, and implementation of compensation, support and resettlement for land eviction as prescribed by law;
i) Organizing to supervise the financial collection of the allocation, lease and transfer of land using purposes, land eviction, land development, land using right auction, land using projects auction;
k) Organizing and managing the operation of the provincial land using rights registering offices, land development organizations (in case this organization put under the Department; guiding, inspecting the activities of the land using rights registering offices of districts and organzing land development under the PPC.
5. On water resources:
a) Mornitoring and coordinating with relevant agencies for planning, plans of managing, using and protecting water resources, preventign degradation, depletion of water resources; implementing after approval;
b) Appraising the projects of exploitation and using of water resources, water transfers among the river basins approved under the authority of the PPC;
c) Implementing the identified limitation of exploited water of rivers, aquifers, water storage areas, water exploiting restricted areas; plans of moderating, allocatiing of water resources in the province;
d) Appraising the extension file, changing the duration, adjusting the content, suspending validity and evicting permits of exploration, exploitation and using of water resources, permits of wasting water into water sources and permits of exploiting groundwater under the authority; issuing license and charging for water resources as prescribed by law; inspecting and testing activities on water resources as specified in the license;
e) Organizing the basic survey, doing inventing and statistics, storing data of water resources in the province; organizing management and exploitation of the water resources construction invested by local government;
f) Reviewing the exploitation and using of water, wastewater into water sources in the province; making a list of contaminated water sources, degradation and depletion;
g) Guiding, inspecting the filling of the wells which are not used as prescribed by law;
h) Participating in interagency organization of the Center, standing interagency organization of local management, exploitation and protection of basin water sources.
6. On Mineral resources:
a) Mornitoring and coordinating with relevant agencies to delineate the banned and temporarily banned areas of mineral resources, delineate banned areas of auction, exploration, exploitation mineral resources as authorized by the PPC; proposing protecting mineral resources methods to the PPC;
b) Appraising the projects of mineral exploration to produce common construction materials and peat; planning the exploration, exploitation, processing and using of minerals as authorized by the PPC;
c) Appraising documents of issuing, renewing, revocating, returning licenses of mineral activities, allowing the transfer, continued operation of mineral activities in cases of inheritance and closure schemes as authorized by the PPC;
d) Appraising the reports of mineral exploration as to produce common construction materials and peat as approval authorized by the PPC;
e) Inspecting, examining and supervising the mineral activities of the organization and individuals; solving disputes, complaints and denunciations about mineral activities; solving or proposing solution of violating the law on minerals as prescribed by law;
f) Managing, storing and providing information and data on mineral exploration to produce common construction materials and peat; doing statistics and inventory of mineral reserves approved and periodically report to the Ministry of Natural Resources and Environment.
7. On the environment:
a) Evaluating the current condition of the local periodically; investigating, identifying contaminated environmental areas, making a list of establishers causing environmental pollution, causing serious environmental pollution in the area and periodically reporting to the PPC, the Ministry of Natural Resources and environment as prescribed by law and checking their implementation of environmental pollution improvement;
b) Mornitoring or coordinating with relevant agencies to build and implementing plans of mobilizing the sources to cope and overcome the environmental pollution caused by environmental incidents as assigned by the PPC;
c) Issuing, renewing and revocating licenses of wasters, collectors, shippers, handlers hazardous waste as prescribe by law; guiding, inspecting, issuing certification to eligibly importing scrap as authorized;
d) Appraising the strategied environmental assessment report, and environmental impact assessment report, environmental protection projects, the projects establishing natural reserves and biodiversity as authorized by the PPC; guiding and inspecting the implementation after approval;
e) Mornitoring and coordinating to implement interdisciplinary programs and schemes of protection, improvement and recovery environmental landscape, conserving and developing the wetlands (if any) as assigned of the PPC;
f) Guiding the construction, organization and management of environmental monitoring systems as prescribe by law; doing statistics and storing data of the local environment;
g) Organize the activities of popularizing environmental protection within the functions of the Department;
h) Organizing to charge fee of appraising the report on environmental impact assessment, environmental protection charges for waste as prescribed by law;
i) Aggregating the estimation of the local environmental protection agencies and coordinating with the Department of Finance to report the PPC and the People's Councils at the same level; nornitoring and coordinating with the Department of Finance to manage the local fund of environmental protection (if any) as assigned by the PPC.
8. On meteorology:
a) Appraising documents of issuing, extending, adjusting the content and revocating license of the local specilaized meteorological and hydrological works as authorized by the PPC and supervising the implementation;
b) Mornitoring the appraisal of projects of investment, construction, renovation and upgrading of the specialized meteorological and hydrological works; participating in developing plans to prevent, combat and overcome the consequences of natural disasters in the province;
c) Being responsible for coordinating with the Center and local relevant agencies in protecting, solving the violations of the technical safety corridors of the Center meteorological and hydrological works in the province;
d) Aggregating and reporting on the condition and impact of climate change on natural factors, human, economic and social status of the area; coordinating with the relevant agencies to propose and recommend the appropriate solution.
9. Measuring and Mapping
a) Confirming registration; appraising documents and proposing the agency having authorization of issuing, supplementing, extending and revocating license to measurement and mapping as prescribe by law;
b) Organizing and managing the disseminating activities of measuring and mapping according to the plans; quality management of works and products of measuring and mapping; unified management of the entire system of local measuring and mapping data; managing security, storage, provision and utilization measuring and mapping information and data; managing the protection of construction of measuring and mapping;
c) Managing and organizing the construction, renovation, exploitation of local measuring and mapping infrastructure systems, including basis measurement system, database of geographic information, sites system on maps, cadastral mapping system, administrative mapping system, base map, thematic map serving for special purposes, topographic maps;
d) Monitoring the publication and issuing of maps and recommend to the authorized agencies to suspend issuing and revocating the map with errors in showing national sovereignty, administrative boundaries , local sites,and maps with technical errors.
10. Guiding professional management in the field of natural resources and environment for Department of Natural Resources and Environment in districts, professional officers helping the People's Committees of communes, wards and towns (called CPC) manage the fields of natural resources and the environment.
11. Cooperating internationally in managing fields of the Department as prescribed by law and assigned or authorized by the PPC; mornitoring or appraising, assessing and conducting research proposals, schemes, projects applying advanced technologies related to the field of natural resources and environment in the area.
12. Guiding and checking the implementation of the autonomy, self-responsibility of the career agencies under the Department and the other local public agencies which operate public services in the field of natural resources and environment as prescribed by law; being responsible for public services implemented by the Department.
13. Assisting the PPC to manage enterprises, collective economic organizations, the private organization; guiding and inspecting the activities of associations, non-governmental organizations in the field of natural resources and environment as prescribed by law.
14. Inspecting, examining and handling the violations in the fields under the functions and duties of the Department as prescribed by law; settling the complaints and denunciations; combating against corruption as prescribed by law or decentralized, authorized by the PPC.
15. Defining functions, duties, powers and organizational structure of the offices, inspectors, professional offices and career agencies under the Department; payroll management, implementation of the wage regime and policies, remuneration, training, fostering, rewarding, disciplining officers under the management of the Department as prescribed by law and decentralized by the PPC; organizing professional training for officials of districts and communes who are in charge of managing natural resources and environment.
16. Managing finance and property of the Department as prescribed by law and decentralized by the PPC.
17. Creating the database of natural resources and environment; doing statistics, reporting on the management and protection of natural resources and environment as prescribed by law.
18. Performing other tasks as assigned by the PPC or as prescribed by law. (According to Decision No.15/2009/QD-UBND dated 04/23/2009 of An Giang’s PPC)
