Position, function

1. Department of Industry and Trade, the specialized agency of the Provincial People's Committee, helps the Provincial People’s Committee in performing the governmental management of industry and trade including mechanical engineering; metallurgy; electricity; new energy; renewable energy; chemical: Industrial Explosives; industry of mining and mineral processing; consumer industry; food industry; other processing industries; cargo traffic in the province; export; import; border trade; market management; competition management; trade promotion; exclusive control; anti-dumping; anti-subsidy; consumerism; electronic commerce; commercial services; economic integration; industrial cluster and location management in the province; industrial promotion activities; public services under the jurisdiction of the Department and governmental management of environmental protection in industry and trade field.

2. Department of Industry and Trade has legal entity, its own seal and account; under the direction and management of the organization, staffing and operation of the Provincial People's Committee, concurrently subject to the direction, inspection, guidance about the professional competence of the Ministry of Industry and Trade.

Duties and authority

1. To submit to the Provincial People's Committee:

a) Draft of planning, long term plan, plans of every year and every 5 years, guidelines, policies, program, measures, specific provisions on development of local industrial and commercial sector in the area.

b) Draft of decisions and directives issued under the authority of the Provincial People's Committee in the field of industry and trade.

c) Draft of regulation on functions, tasks, powers and organizational structure of Market Administration under the provisions of the Government, the guidelines of the Ministry of Industry and Trade and other authorized governmental management agencies.

d) Draft of regulations on the criteria of titles for heads and deputy heads of units of the Department of Industry and Trade; participat in drafting regulations on the criteria of titles for industry and trade leaders of Industry and Trade Bureau of the district People's Committee, the Economic Chamber of the People's Committees of districts, commune and provincial cities.

2. To submit to the Chairman of the Provincial People's Committee:

a) Draft of decisions on establishment, merger, dissolution of the units under the Department of Industry and Trade in accordance with the law.

b) Draft of particular decisions, directives issued by the Provincial People's Committee Chairman in the industrial and commercial sectors.

3. Guide and supervise the implementation of legal documents, policies, planning, plans, projects, programs and regulations on industrial and commercial development after approval; inform, disseminate information, guide, popularize, educate the law on industrial and commercial sector.

4. Assist the Provincial People's Committee in design evaluation of the investment project for agency construction of the industrial and commercial development in the province as decentralized; evaluate, modify, add, extend and revoke licenses, certificate under the Department of Industry and Trade’s management as regulated by law, as assigned or authorized by the Provincial People's Committee.

5. About industry – industrial handicraft:

a) About mechanical metallurgy:

Implementat planning, plan, policy development of mechanical industry, metallurgy, development of products with high technology content, combining mechanical engineering, automation, electronic industry in the province.

b) About electric power and energy:

- Implement planning, electricity development plans, development of new energy application, renewable energy in the province; 

-Train legal knowledge about electricity and electricity use for power unit in the province; train and upgrade professional competence, electrical safety for staff, technical workers in the rural power management organizations;

- Implement projects of the power price in the province after being approved by the jurisdiction;

- Coordinate with authorized government agencies to examine, inspect electrical power in accordance with the law.

c) About chemicals, industrial explosives and other types of machines, devices that require strictly on technical safety:

- Implement planning, plan, development policy of chemical, explosives and the type of machines, devices that require strictly on technical safety in the province; 

 - Host, cooperate with relevant provincial agencies to examine and handle violations of the management, use, storage and transport of chemicals, industrial explosives, liquefied gas and other types of machines, devices that require strictly on technical safety as required by law.

d) For industry of mining and mineral processing (except the mineral construction materials and cement production): 

- Host the implementation of the plan for exploration, mining and mineral processing in the province after the approval of the jurisdiction;

- Implement planning, plan, development policy of mining and processing of minerals in the province; examine the implementation of environmental protection measures, safety regulations in mining and mineral processing in the province.

đ) About the consumer industry, food industry and other processing industries:

- Implement planning, plan, industrial and commercial development policy after approved including textile-sewing, shoe leather, paper, porcelain, glass, plastic, beer, alcohol, soft drinks, cigarettes, candy, milk, vegetable oil, flour and starch processing;

- Guide and supervise the implementation of the standards, quality standards for industrial products, safety and hygiene, industrial environment; food safety from production to circulation under the management of the Department of Industry and Trade. 

e) About industrial promotion:

- Implement the program, plan, locally industrial promotion schemes, including the work done by the nationally industrial promotion funds and the activities carried out by the locally industrial promotion funds; 

- Organize training, fostering the management competence in implementing industrial promotion activities for staff working in locally industrial promotion.

g) About clusters of industry and industrial handicraft:

- Host, cooperate with relevant agencies in organizing programs, schemes, mechanisms, policies, plans to develop small and medium industrial enterprises, collective economic organization in the area (including trades, rural villages, the cooperatives in the fields of industry and trade); approve the regulations of those organizations;

- Implement preferential mechanisms and policies for investment attraction, import and export, taxation, finance, labor and infrastructure construction, technical clearance, displacement of production facilities, new construction of industry and industrial handicraft clusters in the area after being approved.

6. About trade:

a) Domestic trade:

- Implementing the development planning, plan, mechanisms, policies of infrastructure network of wholesale trade, retail including market types, commercial centers, grocery stores and shops, cooperative trade, commercial services; commercial agents, franchise and other infrastructure businesses;

- Host and coordinate with relevant agencies to guide and organize the implementation of mechanisms and policies to encourage business network expansion, development of associated organizations in circulation of goods, formation of stable circulation channel of goods transport from production to consumption in the province;

- Implement mechanisms and preferential policies, encouragement, production support, business and life for ethnic mountainous regions, remote areas of the province (such as providing essential items, supporting the circulation of goods and trade services...); 

- Synthesize and process market information in the province of the total level of circulation of the goods, total supply, total demand, the level of reserve circulation and fluctuating prices of essential items, the policie items for ethnic mountainous regions, remote areas. Propose solution to the jurisdiction to regulate the circulation of goods in each period.

b) About import and export:

- Implement policies, plans, programs, projects to develop and promote the export of goods; develop services for export and import of goods in the province; 

- Manage import and export commodities of domestic enterprises and enterprises with foreign investment, foreign traders who have no representative in Vietnam in the province. 

c) About border trade (for the border provinces):

- Implement policies on border trade development, including trade quota, trading in sectoral and cross-border of traders in the area;

- Coordinate with the relevant agencies to synthesize the operation of the border gate economic zones; recommend amendments, additional policies, measures to boost border trade to suit local realities in the province.

d) About electronic commerce:

- Host, cooperate with relevant agencies to build infrastructure for electronic commerce applications in the province;

- Implement policy, plan, program to develop, train human resources for electronic commerce management in the area.

e) About commercial promotion:

- Implement programs, plans, schemes of commercial promotion to promote export, support enterprises in the province to build and develop Vietnamese brand; 

- Implement and examine, supervise the registration of commercial fairs, exhibitions, promotion for traders. 

f) About market management:

- Implement market management in the province as regulated by the Government, as guided by the Ministry of Industry and Trade and authorized agencies of governmental management;

- Guide, supervise the implementation of the legislation in the field of industry and trade in organizations, individuals in the province; inspect specialized competence under the provisions of the law; 

- Host, coordinate with relevant agencies in combating smuggling and trafficking in counterfeit goods, prohibited goods, combat production and trafficking of counterfeit and shoddy goods, goods in violation of regulations on intellectual property; oppose acts of speculation and market manipulation, fraudulent trade of organizations and individuals in the province.

g) About competition, antitrust, anti-dumping and anti-subsidy, consumerism:

- Guide and implement the provisions of the law on competition, antitrust, anti-dumping; anti-subsidy, consumerism and ensure a fair competitive environment in the province. Propose modification, addition of issued provisions, documents which do not conform to the competition law to relevant agencies;

- Ask relevant organizations and individuals in the province to provide necessary information and documents for the implementation of tasks as regulated by law on competition, antitrust, anti-dumping and anti-subsidy, consumerism;

- Collect, build the database, manage, provide information about companies with dominant position on the market, the exclusive businesses with their headquarters in the province; about competition rules of the association; about the exclusion.

h) About economic integration:

- Implement plans, programs, specific measures on economic integration, international trade, in the province after being approved; 

- Host, cooperate with relevant agencies to disseminate, propagate, guide the implementation of plans, programs, regulations on economic integration, international trade in the province.

7. Assist the Provincial People's Committee in governmental management for enterprises, collective economic organizations, private economy; guide and supervise the operation of societies, associations and non-governmental organizations of industry and trade in the province as prescribed by law. 

8. Guide, supervise the implementation of the autonomy, self-responsibility of public units under the management of the Department of Industry and Trade in accordance with the law. 

9. Implement international cooperation in the field of industry and trade as prescribed by law and as decentralized by the Provincial People's Committee.

10. Guide professional competence in the field of industry and trade for the Chamber of Industry and Trade under the district-level People's Committee, Economy Office of the People's Committee of districts, communes and cities of the province.

11. Implement plans of researching, applying advanced science and technology in industry and commerce under the management of the Department; guide the implementation of the standards, rules, economic - technical norms, quality of industrial products; build information storage system, provide materials for industry and commerce according to the law.

12. Implement the administrative reform of the Department according to the aim and the content of administrative reform of the Provincial People's Committee. 

13. Inspect, examine, handle violations, complaints, accusations; prevent corruption, negative; practice saving, oppose waste in the field of industry and commerce as prescribed by law or as assigned, decentralized by the Provincial People's Committee.

14. Implement public service in the field of industry and commerce within the management of the Department in accordance with the law. 

15. Define functions, tasks, powers, organizational structure, working relationship of the organizations, units of the Department; manage staffing, implement wage regime and policies, preferential regime, training, improving, rewarding, disciplining officers, servants, employees under the jurisdiction of the Department as prescribed by law and as decentralized by the Provincial People's Committees.

16. Manage allocated finance, asset and the budget as prescribed by law and as decentralized by the Provincial People's Committee.

17. Inform, report periodically and unscheduled report on the implementation of programs, plans, projects to develop industry and trade in the area as regulated by the Provincial People's Committee and Ministry of Industry and Trade.
