FUNCTIONS AND DUTIES

I.    Position and Functions

An Giang Department of Labour, War Invalids, and Social Affairs is a specialised agency of the Provincial People's Committee to advise the committee in performing state management in the following areas: employment; vocational training; labour wages and remuneration; social insurance (including compulsory and voluntary social insurance, unemployment insurance); occupational safety; people with special contribution to the country; social patronisation; child care and protection; gender equality; prevention and control of social evils (hereinafter referred to as “labour & social issues and people with special contribution”) in the province; public services under the management of the Department and to perform tasks and powers as assigned and authorised by the Provincial People’s Committee and as prescribed by law.

An Giang Department of Labour, War Invalids, and Social Affairs is under the direction and management in its organisation, personnel, and operation of the People's Committee of An Giang province, and the direction, inspection, and guidance in professional expertise of the Ministry of Labour, War Invalids, and Social Affairs.
An Giang Department of Labour, War Invalids, and Social Affairs has its legal status, seal, and an account in the State Treasury of An Giang province.

II.    Missions and authorities

1.    To present to the Provincial People’s Committee:

a.    Draft decisions, directives, planning, long-term plans, five-year and annual programs,  projects within the jurisdiction of the Department

b.    Draft legal documents on functions, authorities, and organisation of the Units as components of the Department

c.    Draft documents to specify the conditions, criteria, titles for Heads and Deputy Heads of Units of the Departments as well as Heads and Deputy Heads of the Office of Labour, War Invalids, and Social Affairs at district, town, and city levels under the management of the Department and as prescribed by law.

2.    To present to the Chairman of the Provincial People’s Committee:

a.    Draft decisions and directives issued under the authority of the Chairman of the Provincial People's Committees in the areas of labour, social contributors and society;

b.    Draft decision on establishment, merger, and dissolution of Units of the Department as prescribed by law.

3.    Guiding, inspecting, and organising the implementation of legal documents, planning, plans, projects, programs, and other issues in the fields of labour, social contributors, and society upon approval; organising the dissemination of information, communication, guidance of law education in the areas within the jurisdiction of the Department.

4.    Employment and Vietnamese employees working overseas under contracts.

a.    Propagandising and disseminating national and provincial guidelines, policies, and law for employment and Vietnamese labourers working overseas under contracts.
b.    Organising the implementation of campaigns and measures in employment and development of domestic and international labour markets of the province in accordance with the National Strategic Program on employment 
c.    Guiding and inspecting the implementation of regulations on job creation, policies for special labourers (minor, disabled, elder and other subjects); sending labourers to work overseas; managing and utilising labour force, information on labour market… under the management of the Department.
d.    Managing the operations of job agencies as prescribed by law
e.    Guiding and implementing the sending of Vietnamese labourers to work in foreign countries under contracts as prescribed by law.
f.    Conducting statistics on employment circumstances and the local labourers working overseas under contracts 
g.    Monitoring and coordinating with relevant agencies in dealing with requests and comments of organisations and individuals related to Vietnamese labourers working overseas under jurisdiction of the Department

5.    Social insurance (including compulsory and voluntary social insurance), unemployment insurance

a.    Guiding, inspecting, and handling violations in the implementation of the provisions of the law on compulsory and voluntary social insurance, unemployment insurance under the jurisdiction of the Department;
b.    Coordinating with the competent authorities to advise the Provincial People’s Committee in solving cases related to social insurance in the province.

6.    Vocational training

a.    Organising the implementation of planning, development plans, programs, projects on vocational training schemes in the province upon approval;
b.    Guiding and inspecting the implementation of the provisions of law on vocational training policies for managerial staff, teachers, and students.
c.    Guiding and organising the implementation of training and reinforcing programs, utilising teachers and managerial staff in vocational education.

7.    Employment, remuneration, and wages

a.    Guiding and inspecting the implementation of labour contracts, labour collective bargaining agreements, work disciplines, policies on remuneration, wages, and social insurance for employees; policies for workers in re-arrangement, re-organisation and transformation of state enterprises, business bankruptcy enterprises, dissolution and equitisation enterprises, leasing enterprises as prescribed by law.
b.    Coordinating and guiding the prevention and settlement of labour disputes and illegal strikes in the province
c.    Issuing labour record books, managing, and monitoring the use of labour record books; granting, renewing, and revoking work permit for foreign employees working in economic agencies, enterprises, and organisations in the province as prescribed by law.

8.    Occupational safety

a.    Guiding and organising the implementation of the national program on labour protection, labour safety, labour hygiene; National Week for occupational safety, occupational sanitary, and prevention of fire in the province.
b.    Organising training and granting training certificates on occupational safety and health for employers; implementing regulations on registration of machinery, equipment, and supplies with strict requirements for labour safety in the province as prescribed by law;
c.    Guiding the inspection on the quality of products, special items for labour safety as prescribed by law;
d.    Monitoring and co-organising the investigation of serious labour accidents in the local area; reporting to the Provincial People's Committee and the Ministry of Labour, War Invalids, and Social Affairs on the state of labour accidents; guiding organisations or employers on making reports, investigation, records, statistics, and periodic reports on labour accidents.

9.    People with special contribution

a.    Organising the implementation of State regulations for people with special contributions to the revolutionary course in the province
b.    Guiding and organising the implementation of planning and constructing martyr cemetery, memorable monuments and works of martyrs; martyrs cemetery management in the province;
c.    Monitoring and coordinating to organise the work of collecting, receiving, and burying the remains of martyrs, information and reports on the martyrs tombs, visiting martyrs' graves, re-locating the remains of martyrs.
d.    Joining the Council of medical evaluation on disability and working abilities for contributors of the revolutionary course;
e.    Managing subjects and funds for the implementation of the regime, preferential policies for contributors of the revolutionary course  as prescribed;
f.    Guiding and organising the movement of “Den on dap nghia” (movement of thanks giving to people with special contribution) and managing the “Thanks giving fund”;

10.    Social patronisation

a.    Guiding the implementation of regimes and policies for social patronisation beneficiaries
b.    Guiding and organising the implementation of poverty reduction policies; National Target Program on poverty reduction and other programs, projects, and schemes of social assistance.
c.    Building a grassroots network of social patronisation in the province.
d.    Synthesising, conducting statistics on the number of subjects of social patronisation and poverty in the province.

11.    Child protection and care

a.    Guiding and organising the implementation of programs and action plans on child protection and care in the province
b.    Guiding and inspecting the implementation of the provisions of law on child protection and care under the jurisdiction of the Department, building communes and wards suitable for children.
c.    Organising the implementation of the National Action Program for children, programs, projects and plans on child protection and care for children with special circumstances.
d.    Organising inspection and evaluation on the implementation of child rights as prescribed by law; regimes and policies on child protection and care.
e.    Managing and using the Vietnamese Children Fund of the province as prescribed by law

12.    Social evil prevention and control

a.    Guiding and organising the implementation of programs, plans, and measures to prevent and combat prostitution, drug addiction and HIV/AIDS combat for subjects of prostitution, drug use in centres; supporting the community reintegration for women and children who are victims of trafficking returning from abroad.
b.    Guiding the professional expertise for social work institutions (management units for drug detoxification subjects and prostitutes) in the province.

13.    Gender equality

a.    Guiding and organising the implementation of policies, programs, projects, and plans on gender equality upon approval.
b.    Guiding the integration of gender equality programs in accordance with the socio-economic development plans of the province; organising the implementation of measures to promote gender equality in accordance with socio-economic conditions of the province.

14.    Implementing international cooperation in the field of labour, social contributors, and society as assigned and authorised by the Provincial People's Committee and as prescribed by law.

15.    Assisting the Provincial People’s Committee in performing the function of State management of enterprises, economic collective organisations, private business; guiding and inspecting the operations of non-governmental organisations in the province in the field of labour, social contributors, and society.

16.    Guiding and inspecting the implementation of autonomy, self-responsibility for public service units of the Department of Labour, War Invalids and Social Affairs as managed and prescribed by law.

17.    Conducting research and the application of science and technology, developing database, information and storage systems for the State management and professional services on the assigned fields.

18.    Implementing administrative reform program of the Department, implementing public services under the jurisdiction of the Department as prescribed by the Provincial People’s Committee and law.

19.    Inspecting, testing, handling violations under the authority and settling complaints and denunciations, combatting corruption; practicing thrift in the field of labour, social contributors, and society under the jurisdiction of the Department and as prescribed by law.

20.    Performing the task of gathering statistics and reports on the performance of assigned tasks as directed by the Provincial People's Committee and Ministry of Labour, War Invalids, and Social Affairs.

21.    Providing guidelines and professional expertise in the field of labour, social contributors and society to the Office of Labour, War Invalids, and Social Affairs at district level.

22.    Specifying the functions, duties, authorities, organisational structure, and working relationship of business organisations and units of the Department; managing the organisation, personnel, performance on salary, policies, wages, training and reinforcing, appointment and dismissal, commendation and penalisation of officials and public servants under jurisdiction of the as prescribed by law and decentralised by the Provincial People’s Committee. 

23.    Managing budget and allocated properties and utilising the allocated budget as prescribed by law and assigned by the Provincial People’s Committee.

24.    Performing other tasks assigned by the Provincial People’s Committee and as prescribed by law.
