Position and Functions

1. The Department of Finance is the specialized agency of the provincial People's Committee, which has functions of advising and assisting the provincial People's Committees to implement the state management of finance; state budget; taxes, charges, fees and other receipts of the state budget; state property; state financial funds; financial investment; business finance; accounting; independent audit; price and financial service activities (generally called the financial field) at the local in accordance with law.

2. The Finance Department has legal status, separate stamp and accounts. The department is under the direction and management of the organization, personnel and duties of the provincial People's Committee; is also under the direction and instruction, checking specialty and professional competence of the Ministry of Finance.

Duties and Rights

Department of Finance implement the tasks and powers in accordance with the law in the financial field and the particular following duties and powers: 

1. To present to Provincial People’s Committee:

a) Drafts of decisions, instructions and other documents within the authorization of People’s Committee in financial field;
b) Drafts of programs, long-term, 5-year and annual financial plans in financial field according to the overall plan of developing the local economy and society;
c) Drafts of program, measures to organize the implementation of administrative reforms under the state management of the Department. 
d) Drafts of the legal documents defining specifically the criteria for titles of the chief, deputy of the units of the Department; for the Head and Deputy Head of The office of Finance - Planning of the People's Committee at the district level after consulting with the Department which manages related sectors or fields. .
e) Drafts of plans for income decentralization and expenditure tasks for each local budgets level; for the allocation norm of the local budget for estimated expenditures; charging mode and the contributions of the people according to the law of the People's Council shall decide within its jurisdiction;
f) Estimations of local budget adjustments; the plans to balance the budget and the essential measures to complete the assigned duties of budget collection and expenditure to present to the People's Council for decision within its jurisdiction;
g) Reorganization plan, the processor, the state-owned land within the scope of local management.  

2. To present to the Chairman of the provincial People’s Committee

a) Drafts of decisions, instructions and other documents under the issuing authority of the Chairman of the provincial People's Committee on state management of the Department;
b) Drafts of decisions on establishment, merger, separation, reorganization, dissolution of units of the Department in accordance with the law.

3. To assist the Chairman of the provincial People's Committee to direct, instruct, check, inform, disseminate, popularize education of law in the field of finance; to organize to implement legal documents, policies, plannings, plans, programs, projects, proposals under the state management scope of  Department after the competent authorities issue or approve.

4. On management of the state budget, taxes, charges, fees and other receipts of the state budget:
a) To instruct the administrative offices, the provincial enterprise units and lower level of financial agencies to estimate the annual state budget in accordance with the law.

To implement to check and inspect the budget estimation of the agencies, units at the same level and budget estimation of the lower level; to estimate the collection of the state budget in the province, collection and expenditure of local budget, plans for provincial budget allocation; to report to the provincial People's Committee to present to the Provincial People’s Council for decision;

b) To preside and coordinate with relevant agencies to draw up, present to the provincial People's Committee to issue, under the authority, the documents on money collection of land use, land rents, water surface rents, joint-ventures contribution by values of rights of land use, rentals and sale of state houses and other receipts of the state budget in accordance with the Law of state budget in the field of state properties, land, mineral resources.

To instruct, check and organize the implementation of policy; to determine the collection unit prices and the collection levels of land use, land rents, water rents, joint-ventures contribution by the value of right of land use, rentals and sale of state houses;

c) To coordinate with relevant agencies in implementation of the collection management of tax charges, fees and other receipts in the locality;

d) To examine and supervise the management and use of the budgets at agencies, units spending budgets; to require the State Treasury to halt the payment when there is excessive estimation in expenditure, wrong policy expenditure, regulations or no execution in reporting regulation of the State;

e) To evaluate the settlement of state budget collection arisen in the districts, towns or city (considered as the district level), settlement of budget collection and expenditures at district level; to evaluate and inform the settlement to the administrative agencies, enterprise units and other organizations using the provincial budget; to approve the settlement of funds authorized by the government budget implemented by local.

To summarize the situation of state budget collection and expenditures; to make total annual budget settlement in the local, present to the People's Committee, report to the provincial People's Council for approval, and report to the Ministry of Finance;

e) To manage development and investment capital

- Together with the Department of Planning and Investment and relevant agencies to advise the provincial People's Committee about a strategy to attract, mobilize and use of short-term, long-term foreign and domestic investment; To develop policies and measures to coordinate and improve efficiency of official development assistance (ODA) in the province; to assist provincial People's Committees in the state management of finance for ODA programs and projects in the province.

- To coordinate with the Department of Planning and Investment and relevant agencies for setting the estimation and allocation plans of annual investment and development; to preside and coordinate with relevant agencies to arrange other sources of investment properties the provincial People's Committee decision and present to the Provincial People’s Committee for decision. 

- To coordinate with the Department of Planning and Investment to present to the provincial People's Committee for decision of the investment allocation, lists of investment projects using budget capitals; plans to adjust the allocation of investment capital in case of needs; plans to adjust and regulate capital for investment projects from local budgets.

- To join the investment policies; examine, evaluate, consult under the jurisdiction toward the projects managed by the province.

- To check the implementation of investment plans, the management and use of investment capital, settlement of investment capitals of local budgets of investors and financial agencies at districts, communes; situation of controlling capital payment of the State Treasury in the provinces and districts.

- To organize to examine the investment settlement of completed projects, to present for approval to the chairman of the provincial People's Committee for the projects under the approving authority of the chairman of the provincial People's Committee; to examine and approve the settlement of projects invested by the professional capitals with investment basic construction in accordance with local regulations.

- To summarize, analyze the mobilization and use of capital; evaluate efficiency of the management, use and settlement of local investment capital, then report to the provincial People's Committee and the Ministry of Finance as the regulations. 

g) To manage the funds authorized by the Government, financial reserves in accordance with local law;

h) To unify the management of loans and grants for local in accordance with the laws; state financial management for direct foreign aids to the local as one of the collections of local budgets; to assist the provincial People's Committee implement the issuance of bonds and other forms of local debt in accordance with the Law on state budget;

i) To instruct and check the implementation of financial autonomy of the public enterprise units and autonomy, self-responsibility of the administrative budget toward state administrative agencies in accordance with the law;

k) To instruct and organize to implement publicizing the finance and budget of the state in accordance with the law;

l) To summarize results in implementing the recommendations of the inspection and audit in the fields of budget and finance and report to Provincial People's Committee.

5. On the management of state properties in local government:

a) To develop and present to the provincial People's Committee instruction documents of management and use of state property and management decentralization of state property under the jurisdiction of the local;

b) To instruct, supervise the implementation of the management of state property; to propose financial measures to ensure the effective management and use of state property under the local jurisdiction;

c) To decide under the authority or present to the provincial People's Committee for decision under the authority on purchasing, leasing, withdrawal, transferring, liquidation, selling or destroying of state property, handing-over state property assigned to public enterprise for financial autonomy and using the state property of public enterprise for the purposes of business, service, leasing, joint-ventures and cooperation;

d) To instruct and organize to implement publicizing state property in the state agencies, organizations and units in accordance with law;

e) To coordinate with the Department of Natural Resources and Environment to instruct, examine agencies, organizations and units in implementing the policies of compensation, supporting and resettlement when the State takes land back;

f) To organize to receive, manage, present to the provincial People's Committee for decision of handling or handling under the authority toward the properties which cannot be defined the owner; properties which are hidden or sunk now found; which are confiscated and put into the state funds; which belong to the project using state funds (including ODA capital) when the project end and the other properties are set up the State ownership;

h) To organize manage and exploit state properties which are not allocated to organizations, individuals to manage and use; to manage arisen financial resources in managing, exploiting, transferring and handling state property;

i) To advise the provincial People's Committee with ideas to the Ministries and the Ministry of Finance on the house and land arrangement the governmental agencies manage in the province;

j) To manage the database of state properties under management of the local; to assist the provincial People's Committee to report to the management and use of state property under the jurisdiction of the local.

6. On the management of state financial funds (funds for investment and development; funds for credit guarantee for small and medium enterprises; funds for housing development and other types of state financial funds established in accordance with the law):

a) To preside to draw up projects, evaluate documents of establishing and operating the fund and present to the provincial People's Committee for approval; to advise the provincial People's Committee to decide the issues of objects for investing and loaning; interest rates; allocating charter capital for the funds in accordance with the law;

b) To monitor, check and supervise the funds’ operation; to check and supervise the execution of financial management and implementation of other duties assigned by the provincial People's Committee;
        
c) To check, supervise the use of the capitals from local budgets entrusted to the entrusted organizations (funds for investment and development, the state financial organizations) to for disbursing, loaning, supporting interest rate according to objectives determined by the provincial People's Committee.

7. On management of business finance

a) To instruct to implement policies, regulation of business finance, cooperatives finance and collective economy management; financial policies to serve ownership transformation, rearranging state enterprises, converting professional units into enterprises, equitizing professional units, management mode, preserving and developing of state capital at enterprises;

b) To check the implementation of the law on finance and accounting of the types of businesses in the province in accordance with the law;

c) To manage the state capitals and properties at enterprises, organization of cooperative economy, collective economy established by the local in accordance with the law; to implement rights and duties of a representatives owning the state capital at enterprises as assigned by the provincial People's Committee;

d) To check and supervise managing and using capital, distributing income, setting up and using the funds of the state companies; to check, supervise, evaluate performance of state enterprises;

e) To summarize the situation of ownership transformation, state enterprises rearrangement; to analyze, evaluate the business financial situation in the province, the management, preservation and development of state capital at enterprises established or contributed by the local, reporting to provincial People's Committee and the Minister of Ministry of Finance;         

e) To generally evaluate the implementation of finance mechanism serving policies of developing cooperatives, collective economy in the province in accordance with the law.

8. On price management and valuation:

a) To preside to draw up plans for the prices of goods, services and control element to form prices for goods and services within its jurisdiction;

b) To evaluate price plans of properties, goods and public services; order and assign plans,   products; monopoly position will be presented to the provincial People’s Committee for decision by the departments, units, or construction business;

c) To coordinate with relevant agencies to organize consulting prices, controlling prices monopolies, anti-dumping, listing prices, and selling according to listed prices;

d) Evaluate draft decisions of issuing price table of land types and plans of land prices in the local will be presented to the provincial People’s Committee for decision  by Department of Natural Resources and Environment;

e) To publicize the list of goods and services with price stabilization, registration and declaration and apply measures to stabilize prices in the local in accordance with the law;

e) To collect, analyze and forecast the price fluctuation in the province; report the implementation of state management on local prices in according to the regulations of the Ministry of Finance and the provincial People’s Committee;

g) To preside to coordinate with relevant agencies to examine the implementing the law on prices and valuating prices of organizations and individuals operating in the province.

9. To instruct, manage and check the implementation of regulations the law towards organizations supplying financial services in finance, accounting, independent auditing, and financial investment; business enterprises of lottery, gambling and games with rewards in the local area according to regulations of the law..

10. To inspect, examine and settle complaints and denunciations; to handle under the authority or to propose the competence authorities to handle violations of law in the areas under the state management of the Department; to prevent corruption, negative activities and practice saving and object to wasting in using the property, funds which are allocated in accordance with the law.

11. To assign the functions, duties and authorities of the Offices, Inspectors, specialty and professional competent offices, departments and the career units of the Department; to manage the Department’s personnel; implement the salary policies, treatments, trainings, fostering, rewards, punishments toward the officers, civil servants and office-holders under the management of the Department under decentralization of the provincial People's Committee and in accordance with the law.

12. To implement international cooperation on finances in accordance with the law and the assignment or authorization of provincial People’s Committee.

13. To organize to do research and apply the advance of science and techniques; set up the information system, storage system to serve the financial management and professional tasks which are assigned. .

14. To implement other duties assigned by provincial People’s Committee and in accordance with the law.
