Position and Functions
Department of Agriculture and Rural Development is a specialised agency of the People's Committee of An Giang province and has the function of advising and assisting the Provincial People's Committee in performing state management in local areas in the fields of agriculture, forestry, aquaculture, irrigation, and rural development; flood and storm prevention; safety of agricultural, forestry and fishery products from the production process to the market; public services in agriculture and rural development; and implementation of tasks and powers under the authority of the Provincial People's Committee and as prescribed by law.
Department of Agriculture and Rural Development has legal status, own seal, and account under the direction and management in organisation, personnel, and operation of the Provincial People's Committee; and under the direction, inspection, and professional guidance of the Ministry of Agriculture and Rural Development.
Missions and authority
1. To submit to the Provincial People’s Committee:
a. Draft decisions and directives; long-term development plans, annual and 5-year plans; programs, projects in agriculture, forestry, aquaculture, irrigation and rural development; plans in natural disaster prevention and mitigation in accordance with the master plan for socio-economic development, national defense and local security objectives; programs and measures for the implementation of the tasks in state administration reform in the assigned areas under the jurisdiction of the State.
b. Draft documents to specify functions, duties and authorities of Sub-departments
c. Draft legal documents to specify the conditions and criteria for the titles of Heads and Deputy Heads of the units of the Department; Heads and Deputy Heads of the Division of Agriculture and Rural Development of the People's Committee at district level; participation in drafting conditional regulations, standards, titles of leaders in the Agricultural Unit of the Economic Department of the People's Committees of districts, towns, and cities of the province.
2. To submit to the Chairman of the Provincial People’s Committee:
a. Draft decisions on establishment, merger, and dissolution of units of the Department as prescribed by law;
b. Draft decisions and directives issued under the authority of the Chairman of the Provincial People's Committee
c. Promulgating regulations on the management, coordination, and reporting regime of the province-level organisations in the field of agriculture and rural development located in districts with district-level People's Committees; the technicians in communes with the commune-level People's Committee.
3. Guidelines and implementation of approved legal documents, development plans, programs, projects, national standards, national technological regulations, and economic-technological norms in agriculture, forestry, aquaculture, irrigation, and rural development; information, communication, dissemination, and law education in the assigned areas under the jurisdiction of the State.
4. Agriculture (Crop production and animal husbandry)
a. Taking responsibility for organising the implementation of the plan in land utilisation for crop production and animal husbandry upon approval and measures against degradation of agricultural land in the province as prescribed by law;
b. Guiding and inspecting the implementation of the State regulations in seedlings and animal breeds, fertilizers, animal feed, pesticides, veterinary medicine and other supplies for agricultural production as prescribed by law;
c. Assisting the Provincial People's Committee to direct agricultural production, harvesting, storage and processing of agricultural products; performing breed structure, seasonality, techniques in cultivation, crop production, and animal husbandry;
d. Organising crop and animal health protection (including aquatic animal health), prevention and remedial of animal and plant diseases; guiding and implementing domestic quarantine of animals and plants in the province as prescribed by law;
e. Organising prevention and remedial of natural disasters, pests, and diseases in agriculture
f. Managing and using local reserves of crop and animal breeds, pesticides, veterinary medicine, supplies and goods in the fields of farming, animal husbandry in the province upon approval of the Provincial People’s Committee
5. Forestry
a. Guiding the preparation and taking responsibility for evaluating plans of forest protection and development of district-level People's Committees;
b. Assisting the Provincial People's Committee in deciding to establish protection forests, special-use forests, and production forests under the jurisdiction of local authorities upon approval; identifying border line of various kinds of forestry, conducting statistics, inventory of and monitoring forests under the guidance of the Ministry of Agriculture and Rural Development;
c. Organising the implementations of the forest allocation plan for districts and communes upon approval; implementing the allocation and lease of forests, forest recovery, changes in forest uses, recognition of forest use rights, ownership of production forests as planted forests for Vietnamese organisations and citizens overseas, the outside organisations and individuals for investment projects in forestry in the province; organising the preparation and delivery of records in leasing forests and land of plantations
d. Assisting the Provincial People's Committee to direct the district-level People's Committees in performing forest allocation for communal communities, villages and forest allocation, forest lease for families and individuals as presribed.
e. Organising the evaluation, selection, and recognition of maternal plants, initial plants, and forest seedlings in the province. Developing plans, measures, and guidance, inspection and responsibility in producing forestry seed and using forestry materials; afforestation; processing and preservation of forest products; preventing and controlling harmful diseases to forests and forest fires;
f. Taking responsible for approving forest management and forest harvesting design; assisting the Provincial People's Committee to direct and inspect the afforestation and protection of watershed forests, special-use forests, and protection forests as prescribed;
g. Guiding and inspecting in opening forest and exploitation permit; assigning the exploitation plan for the forest owners, namely organisations and district-level People's Committees upon approval; the implementation of the regulations on the responsibilities of the People's Committees at district and commune-level in the management and protection of local forest; coordination and mobilisation of forces and means of the organisations and individuals in the province for forest protection, forest product management, and fire prevention.
6. Fishery
a. Guiding and inspecting the implementation of the regulations for the movement of aquatic species in applying methods of fishery exploitation; announcing the additional regulations of the Ministry of Agriculture and Rural Development on the list of fishery species of prohibited exploitation and time of no exploitation; the banned fishery exploitation measures and tools; species, the minimum size of aquatic species that could be exploited; exploitation seasons and prohibited areas suitable for exploitation of fishery resources in the province;
b. Guiding and inspecting the implementation of the decision of the Provincial People's Committee on the establishment of local preservation areas; management regulations of those preservation area under management of local authority and regulations of fishery exploitation in the rivers, lakes, and other natural water areas under the jurisdiction of the provinces as guided by the Ministry of Agriculture and Rural Development;
c. Organising assessment of fishery resources in the province under the jurisdiction of the State
d. Guiding, inspecting detailed plans of aquaculture areas. Taking responsible for evaluation plans, aquaculture plans at district level and implementing the management of aquaculture areas;
e. Advising and assisting the Provincial People's Committee to implement the allocation, lease, and revocation of water areas under management of local authority for aquaculture as prescribed;
f. Organising quality inspection and quarantine of fishery species in the aquaculture agencies; implementing prevention and remedial of fishery disease in the province in accordance with regulations;
g. Guiding, inspecting, organising the implementation of regulations on decentralisation of fishery vessels, ports, and landing sites as well as inspection of fishing vessels under the jurisdiction of the province as assigned state management tasks; the regulation and management of activities organised by the wholesale fish markets
7. Irrigation
a. Guiding and inspecting the implementation of the regulations of the Provincial People's Committee for decentralising management levels of small and medium irrigation and rural drainage programs in the province; guiding, inspecting and taking responsible for the construction, exploitation, utilisation, and protection of small and medium irrigation projects; implementing the rural drainage program upon approval;
b. Implementing regulations on the management of rivers, canals, utilisation, and development of canals and rivers in the province as planned and approved by the authority
c. Guiding, inspecting, and taking responsibility for dike development, exploitation, and protection; protecting the flood and storm prevention system; developing plans, measures and implementing the prevention of floods, storms, drought, flooding, acidic and saline intrusion, erosion, and landslides along the river in the province;
d. Guiding the development of plan for utilising irrigation land, organising locating boundary markers on the field and developing plans and measures for housing relocation related to the scope of dikes and river bank protection as regulated;
e. Guiding and inspecting the implementation of regulations in state management of exploitation and protection of irrigation works; the protection of dike level IV, V; the decision to divert and slow down the flood to protect dikes in the local area as prescribed.
8. Rural development
a. Synthesising and presenting to the Provincial People's Committee the mechanisms, policies, and measures to encourage rural development; household economic development, rural farm economy, economic cooperation, agricultural, forestry and fishery cooperatives associated with the industry, rural craft village in the commune level. Monitoring and reporting to the Provincial People's Committees of rural development in the local area
b. Guiding and inspecting the implementation of regulations in allocating and decentralising tasks in evaluating programs and projects related to migration and resettlement in rural areas; plans in economic restructuring and rural development programs; the development of industry, rural craft villages associated with households and cooperatives in the province; directing, guiding, and inspecting the implementation upon approval;
c. Guiding the development of household and farm economy, economic cooperation, cooperatives, the development of the industry and rural craft villages in the province
d. Guiding and inspecting the implementation of the cultivation, migration and resettlement in agriculture and rural development in accordance with the local socio-economic development plan
e. Organising the implementation of programs, projects, or components of programs and projects for poverty reduction, plans for new rural areas and for constructing residential areas; building rural infrastructure as assigned or authorised by the Provincial People's Committee.
9. Processing and trading agricultural, forestry, and fishery products
a. Guiding and inspecting the implementation of plans, programs, mechanisms, and policies to develop the fields of processing associated with producing and marketing of commodities under the jurisdiction of the Department; the development policy of agricultural-mechanical engineering, industry, villages associated with households and cooperatives upon approval of the authority;
b. Guiding, inspecting, and evaluating the development of the commodity processing and the field of electricity, industry, rural craft villages, post-harvesting storage under the jurisdiction of the Department;
c. Organising the implementation of commercial promotion of agricultural, forestry and fishery products under the jurisdiction and management of the Department;
d. Coordinating with associated agencies to organise the forecasting markets, promotion of agricultural, forestry and fishery products
10. Organising the agricultural extension and the application of science and technology in agriculture, forestry, and fishery.
11. Developing and directing the implementation of environmental protection measures in agriculture, forestry, fishery, and rural development activities in the local area.
12. Organising the implementation and taking responsibility for the inspection, registration, granting, revoking work licenses and certificates under the jurisdiction of the Department as prescribed by law or as assigned and authorised by the Provincial People’s Committee and as guided by the Ministry of Agriculture and Rural Development.
13. Building database and storage system on agriculture, forestry, irrigation, and rural development; organising the statistical work of agricultural land, forest land, forest changes, and water area for aquaculture as prescribed.
14. Guiding and inspecting the implementation of the project and building the model for agriculture, forestry, fishery, irrigation and rural development in the province; taking responsibility for implementing programs and projects as assigned.
15. Implementing international cooperation in the areas under the jurisdiction of the Department as assigned by the Provincial People's Committee and as prescribed by law.
16. Guiding and inspecting the implementation of the autonomy, self-responsibility of the associated business units and the public business units in the field of agriculture, forestry, fishery, irrigation, and rural development in the province as prescribed by law; taking responsibility for public services implemented by the Department.
17. Assisting the Provincial People's Committee in state management for enterprises, economic organisations, and private economic sectors; guiding, inspecting the activities of associations, non-governmental organisations in the fields of agriculture, forestry, fishery, irrigation, and rural development as prescribed by law.
18. Providing professional guidelines for the Division of Agriculture and Rural Development and inspecting the implementation of regulations on management, coordination, and reporting system between agriculture and rural development organisations at provincial level located in districts with district-level People's Committees; the between technical staff in the commune with commune-level People's Committees.
19. Organising research and application of science and technology in the production of agriculture and rural development in the province.
20. Inspecting and resolving complaints and denunciations against corruption, and dealing with violations of the law on agriculture, forestry, fishery, irrigation and rural development in the jurisdiction of the Department as prescribed by law.
21. Performing acting duties of the Committee for the prevention and control of floods and storms, for search and rescue; the urgent issues of fire protection and prevention in the province as prescribed by law; participating in overcoming the consequences of natural disasters of hurricanes, floods, erosion, landslides, droughts, flooding, acidic and saline intrusion, and diseases in agriculture, forestry, and fishery in the province.
22. Directing the implementation of administrative reforms in the areas under the jurisdiction in state management of the Department upon approval of the Provincial People's Committee.
23. Specifying the functions, tasks, authorities and organisational structure, work relationship of organizations and business units of the Department; managing officials, public servants, and employees as prescribed by law and as decentralised by the Provincial People's Committee; organising training and reinforcing programs for officers, servants, employees and officials of communes, wards and towns in managing agriculture, forestry, fishery, irrigation and rural development as prescribed by the Ministry of Agriculture and rural Development and the Provincial People's Committee.
24. Performing finance and property management of the Department as prescribed by law and decentralised by the Provincial People's Committee.
25. Performing periodic and fortuitous reports on the implementation of state management tasks assigned under the regulations of the Provincial People's Committee and the Ministry of Agriculture and Rural Development.
26. Performing other tasks as assigned by the Provincial People's Committees or as prescribed by law.
