Position and functions

1. Department of Education and Training is the specialized agency that belongs to the provincial People’s Committee and functions of advising and assisting the provincial People's Committee in performing the state management of education and training, including: objectives, programs, educational and training content, standards of teachers, education managers; standards of facilities, school equipments and children toys; examination regulations, diplomas and certificates.

2. Department of Education and Training has separate legal status, seal and account, under the direction and management of the organization, staffing and operation of the provincial People's Committee, while under the direction, guidance, control and inspection of the professional competence and speciality of the Ministry of Education and Training.

Duties and powers

1. Chair and coordinate with relevant agencies and submit to the Provincial People's Committee:

a) Drafting decisions, directives and documents issued under the authority of the Provincial People's Committee for the development of education;

b) Drafting five-year plans and annual plans, programs and projects in the field of education and training, measures of organizing and performing the state administrative reformation in the field of education under the state management assigned;

c) Drafting tuition fees and entrance fees specific to the educational and training institutions within the scope of local management for the Provincial People's Committee to submit to the People's Council of the same level to ratify by law;

d) Drafting regulations about the criteria of titles for Heads and Deputy Heads of units of the Department, Heads and Deputy Heads of Education and Training Division of district, town or city-level People's Committee.

2. Chair and coordinate with relevant agencies to submit to the Chairman of the Provincial People's Committee:
Drafting decisions of establishment, pertmit of establishment, merger, division, dissolution, transformation of the educational institutions (including educational institutions involving investment of oversea organizations and individuals): professional seconday schools, secondary schools, multi-level high schools, continuing education centers, ethnic minority boarding schools, language centers, information and technology centers, and other educational institutions (if any), under the authority of state management of the Provincial People 's Committee.

3. Guiding, programming, popularizing and implementing legal documents on education; projects, plans, schemes, programs and other contents on education and training after being issued the authority of approval.

4. Guiding, implementing and examining professional competence and speciality of educational institutions under Department of Education and Training and Division of Education and Training in implementing educational goals, programs, content and plans; admissions, exams, granting diplomas and certificates,  verifying education quality, universalizing secondary education, anti-illiteracy, building a learning society in the area and other educational activities under the guidance of the Ministry of Education and Training.

5. Guiding the educational institutions to locate jobs and define number of people working; aggregating employment positions and number of people employed by educational institutions annually under the Department; submitting to the competent authority to approve the list of job positions and number of people working for the educational institutions under the Department; organizing and supervising the recruitment, use, contracts, transfer, secondment and implementation of policies for public servants and officers of educational institutions and public servants of Department of Education and Training 

6. Making decision of appointment, reappointment, dismission, transfer, demotion on the head and deputy head of organizations under the Department and educational institutions under the Department; recognizing, unrecognizing directing board, chairman of directing board, principal, vice principal of non-public educational institutions under the state management of the Provincial People's Committee, including private colleges locating in the province;

7. Co-chairing with Department of Finance and Department of Planning and Investment specifying criteria and expenditure norm of education in accordance with local reality; estimating annual education budget; making decisions of allocation and distribution of budget for educational institutions under the Department after they have been approved by the competent authorities; coordinating with Department of Finance and Department of Planning and Investment to determine and balance the state budget for local annual education and submit to the competence authorities for approval; guiding, inspecting and supervising the use of state budget and other legal sources of revenue for education in the province;

8. Performing management of finance, assets and facilities assigned in accordance with the law and the Provincial People's Committee;

9. Guiding construction and aggregation of training plans, training public servants and officiers of educational institutions across the province;

10. Performing statistics, information and reports periodically and annually about educational organization and activities for the Provincial People's Committee and the Ministry of Education and Training;

11. Organizing the construction and replication of advanced models; performing emulation and commendation of education in the province;

12. Guiding and organizing the implementation of mechanisms and policies on educational socialization; mobilizing, managing and using resources for the development of education in the province;

13. Organizing the application of scientific achievements - advanced technologies, initiatives and experience in education, aggregating initiatives and local experience; managing scientific research - technology in educational institutions; building information systems and storage service for sate management and professional competence and specility asigned;

14. Assisting the Provincial People's Committee in managing authorized educational institutions, including colleges, professional secondary schools (not including public colleges and professional secondary schools of Central ministries or branches locating in the area), secondary schools, multi-level high schools, ethnic minority boarding schools, ethnic minority semi-boarding schools, continuing education centers, language centers, information and technology centers, and other educational institutions, under control of the provincial People 's Committee; 

15. Assisting the Provincial People's Committee in examining legal compliance in education in ensuring the conditions of establishing schools, educational activities, opening training branches, publicising education quality, higher education training in association with social needs for in the province as prescribed by the Ministry of Education and Training regulations; 

16. Making decision to open major code for intermediate level of professional secondary schools under Department of Education and Training as prescribed by the Ministry of Education and Training regulations;

17. Making decision to allow educational activities, suspend educational activities of the institution as defined at Point a in Paragraph 2 of Article 3 of the Regulations of the Ministry of Education and Training;

18. Coordinating with the Department of Planning and Investment appraising conditions and standards in order for authorized agencies to issue certificates of educational investment for oversea organizations and individuals; granting and revoking operating licenses; guiding and inspecting educational activities of educational institutions involving investment of oversea organizations and individuals as prescribed by laws;

19. Performing international cooperation duties in the field of education assigned by the Provincial People's Committee as prescribed by laws;

20. Assisting the Provincial People's Committee in state managing associations and non-governmental organizations in the field of education in the area as prescribed by laws;

21. Assisting the Provincial People's Committee in state managing service organizations bringing people to study abroad in accordance with the law; inspecting the operation of such organizations in accordance with the Ministry of Education and Training and laws; doing statistics and aggregating number of people researching and studying abroad under the management of the Department in the province, reporting the competent authority as prescribed;

22. Guiding and inspecting the implementation of the autonomy and self- responsibility for the mission, organization, staffing and finance of education and training units under the management of the Provincial People's Committee as prescribed by laws.

23. Performing administrative reform, saving practice, anti-corruption, anti-waste, inspection and settlement of complaints, denunciations and proposals related to education, and violations treatment as prescribed by laws;

24. Defining functions, duties and powers of offices, inspectors, professional offices and providing units under the Department; managing personnel, officers and public servants of agencies and units under the Department;

25. Performing other duties assigned by the Provincial People's Committee or prescribed by laws.
